0:58 that can be okay but you've got to be
1:00 very careful are you liable if you runs
1:02 over one of your farm workers in the field

1:06 without it the answer an employer could
1:07 risk interruptions and work temporary
1:09 loss of equipment and even serious
1:13 liability so if that driver in the story
1:15 earlier that was pulled over by highway
1:18 patrol if he had a driver's license and
1:23 the
1:26 highway patrol could have called to have
1:29 that vehicle towed the tractor towed and
1:32 if you think it's expensive to have your
1:36 honda civic impounded and towed in to
1:38 the police yard and get it out of the
1:42 police chart it is expensive huge towing
1:45 bill and the impound bill
1:48 just think how expensive it is
1:50 to do that with a tractor or especially
1:54 a tractor and a trailer with a disc or
1:55 god knows what's getting impounded it
1:57 could be megabucks
1:58 megabucks
2:01 and not only is it the cost of getting
2:04 your equipment back but it can take time
2:06 in some cases lots of time to go through
2:09 the red tape and you need that equipment
2:11 for your business
2:13 no tractor no work
2:18 remember driver's license is not
2:20 required to operate implements of
2:22 husbandry in the field on roads when
2:25 traveling between fields but it does not apply
2:26 apply
2:29 if the employee has had driving
2:31 privileges suspended or revoked
2:34 if they've had drivers
2:37 license privileges suspended or revoked
2:39 they can't be on any implement of husbandry
2:40 husbandry
2:41 at all
2:47 if an employee is stopped while driving
2:49 fine farm equipment on a public road by
2:50 a law enforcement officer who finds the
2:53 employees driving privileges have been
2:55 suspended or revoked the farm equipment
2:57 will be seized [Music]

3:01 lots of money
3:03 big problems big headaches and you don't
3:09 seizure of the vehicle will interrupt
3:11 the employer's work schedule
3:15 and that tractor or trailer or other
3:17 implement can be held for up to 30 days
3:21 before they have to give it back
3:23 in the event of an accident under these
3:25 circumstances the employer could face
3:28 serious liability so the
3:31 tractor driver goes out there
3:36 even at no fault of the employee
3:38 if they had somebody just run into them
3:39 and they were doing everything else
3:40 right the fact that they have a
3:43 suspended or revoked license puts
3:44 puts
3:51 even without a license an employee could
3:54 have suspended driving privileges even
3:56 if he or she has never had a driver's
3:58 license if an individual without a
4:01 license is arrested for a violation such
4:04 as driving under the influence the court
4:07 can still suspend driving privileges the
4:10 dmv assigns an x number driver's license record
4:15 i won't um into the details but i think
4:17 my best friend got his
4:20 first driving record
4:23 when he was 13.
4:27 anyway um so it happens
4:29 and that followed him for years a worker
4:31 with suspended license can still operate
4:33 equipment in the field but is prohibited
4:40 so that leads us to a whole nother area
4:43 cargo securement and i'll tell you right
4:45 now that some of the details here uh
4:48 change and i haven't
4:51 i haven't gone back to look at where the
4:52 exact numbers are but with cargo
4:55 securement this is how you secure or tie
4:57 down a load
4:58 and as
5:02 everything else
5:04 has an exception it seems in the law
5:07 cargo securement is no different in
5:10 agriculture the cargo securement rules
5:12 have tightened but they're still not the
5:14 same as if you're
5:17 bringing a load of
5:19 construction equipment to a job site
5:23 agriculture is slightly different
5:25 um california has maintained its own
5:28 standards for agricultural haulers for
5:30 cargo securement but is facing a
5:32 requirement to conform to federal
5:34 standards i'm not sure where that stands
5:36 right now i think there still are a
5:39 couple of minor exceptions minor differences
5:40 differences
5:42 in california but it makes it difficult for
5:43 for
5:46 companies and drivers if you've got
5:48 rules that apply
5:52 most states but california is different
5:54 it's just harder to keep it
5:58 straight california agricultural hollers
5:59 operate under
6:02 an exemption from federal
6:05 law but even under federal law ag isn't
6:08 the same as other types of material
6:10 secured to the back of a truck or trailer
6:13 trailer
6:14 now it does say current exemption
6:18 expires april 30th 2019
6:20 due to the pandemic i haven't even
6:23 looked at what's happened in the post
6:25 post
6:28 exemption period
6:32 don't worry about those details
6:35 each motor carrier hauling agricultural
6:37 products must apply for an exemption so
6:39 it's not automatic
6:41 you have to
6:44 file for an exemption
6:46 for your company
6:48 in order to have this be valid and you
6:51 need that exemption record with the vehicle
6:53 vehicle
6:55 you need any information
6:57 call the california highway patrol
6:59 commercial vehicle section and i think
7:02 that number is current if not they are
7:05 pretty easy to find
7:07 so in your application you've got to say
7:10 who the carrier is the company
7:13 your carrier id number contact
7:15 information all of that
7:19 and each vehicle that is within that
7:22 carriers or companies
7:26 operations must have the exemption
7:28 paperwork in the vehicle
7:31 and then you submit reports based on that
7:32 that
7:35 carrier exemption
7:37 don't worry about the details but essentially
7:38 essentially
7:40 you're reporting
7:42 how that vehicle has been used to
7:46 transport agricultural products
7:48 the types of things the amount and the
7:50 miles etc all of that you're reporting monthly
7:52 monthly to
7:53 to
7:56 the highway patrol
7:58 what if there's an accident um
7:59 um
8:02 cargo falls off the vehicle
8:04 you must immediately notify
8:08 the uh highway patrol and then within 72
8:10 hours there's some other paperwork that
8:12 you have to do um
8:14 um
8:16 i knew one guy
8:19 he used it as an excuse to go his visit family
8:20 family
8:22 in mexico and get a new job when he came
8:25 back he had cargo fall off his
8:29 strawberry uh hauling truck
8:30 he left the strawberries in the middle
8:32 of the road the truck and just left the country
8:34 country
8:36 um that was a bad day for
8:39 for us but uh um
8:41 um whatever
8:42 whatever
8:45 it happens you're supposed to report
8:48 things you're supposed to do your job um
8:55 now there are minimum performance
8:58 criteria for cargo securement
9:01 now you're using some kind of rope strap
9:03 tie down
9:05 tarp etc there's a lot of different
9:07 things you can use depending on the situation
9:09 situation
9:10 uh but the performance
9:13 criteria go into
9:16 g forces or gravity forces
9:17 so for example if i've got something
9:20 that weighs a thousand pounds and i need
9:25 to put it secured on the back trailer
9:30 the deceleration force must be 0.8 or 80
9:33 percent of that or 800 pounds of force
9:35 so whatever device i'm using to secure
9:38 that when i slam on the brakes and that
9:43 thousand pounds of cargo pushing forward
9:46 must be able to exert up to 800 pounds
9:49 of that thousand pounds in a forward direction
9:50 direction
9:53 with a safe securement
9:54 securement method
9:56 method
9:59 uh the rearward rearward direction so
10:01 when you're accelerating or going up a hill
10:02 hill
10:04 cargo might be trying to
10:06 uh move backward off the trailer
10:08 backwards that's
10:10 rearward direction and it needs to be
10:13 able to hold half the load so
10:15 for every thousand pounds of load that
10:18 securement needs to be
10:21 suitable rated to at least 500 pounds
10:23 for every thousand pounds of load it's securing
10:25 securing
10:27 and lateral direction side to side
10:29 you're going around corners it also
10:33 needs to be half the load assuming half
10:35 the full force of the weight of the load
10:37 could be going
10:40 left or right against the securement
10:42 devices and it's not just the ropes or
10:50 performance criteria for devices to
10:53 prevent vertical movement of loads that
10:55 are not contained within the structure
10:58 so there must be a downward force at
11:00 least equivalent to twenty percent the
11:01 weight of the article of cargo so you've got
11:02 got
11:04 you know if you've got a thousand pounds
11:06 of stuff i'm trying to secure i need a
11:08 200 pound force pushing down
11:11 to keep it from bouncing up or somehow
11:13 coming loose off of the vehicle
11:14 vehicle
11:16 if there's other loose things
11:18 i also need to have some sort of a
11:21 netting or tarp to prevent things from
11:23 blowing off with the wind that's not
11:26 on this particular slide but that is an
11:31 important additional criteria
11:33 prohibition on exceeding working load
11:35 limits cargo securement devices and
11:38 systems must be designed
11:41 installed and maintained to ensure that
11:44 the maximum forces acting on the devices
11:46 or systems do not exceed the working
11:49 load limit for the device so the devices
11:51 are rated there are clamps there are hooks
11:52 hooks
11:55 there are anchor points there are
11:58 webbing or strapping there's ropes and
12:02 all of them come with some sort of rating
12:04 rating
12:06 and there should be some sort of method
12:08 for inspecting
12:10 and determining when
12:13 that rating is no longer uh
12:14 uh
12:16 no longer being met
12:18 ropes begin to fray
12:21 webbing or flat strapping also begins to
12:25 fray and get some problems with the
12:35 cam devices get
12:36 get old
12:37 old
12:40 rusty or oxidized in some other way if
12:42 it's not iron it doesn't rust but it
12:44 still could oxidize um
12:46 um
12:48 i i've seen some straps that just blow
12:50 my mind
12:53 some of the straps i've seen
12:55 look like they came out of the early 70s
12:58 and they're frayed all over the place it
13:01 looks like a bad hair day um
13:02 um
13:09 equivalent means of securement cargo
13:13 that is immobilized or made to not move
13:15 or secured in accordance with the
13:18 applicable requirements
13:20 is considered as meeting the performance criteria
13:21 criteria
13:23 of this section so uh
13:24 uh
13:27 essentially that means that as it's
13:30 defined within the california law
13:34 if you have something that meets the
13:38 same safety standards of
13:40 securement but it doesn't follow the
13:43 exact same methods that's okay you can
13:46 have alternative ways of securing things
13:48 as long as you can demonstrate that it meets
13:49 meets
13:58 a commercial vehicle registration act
14:00 a commercial vehicle is any motor
14:02 vehicle over ten 000 gross vehicle
14:04 weight with some of these big vehicles
14:06 that we have now some of the large
14:09 trucks hummers and uh
14:12 other recreational vehicles a lot of
14:14 things uh that are
14:18 being purchased by homeowners
14:20 falls within this commercial
14:22 commercial
14:24 gross vehicle weight
14:25 there is an exception for the larger
14:28 pickups at least the medium-sized pickups
14:29 pickups
14:30 that 11
14:33 500 gross vehicle weight or less so you
14:35 have to find out for sure as you're
14:36 registering a vehicle most people don't
14:38 have to worry about a
14:41 personal vehicle because the dealership
14:42 the dmv
14:45 handles that whether or not you're
14:47 commercial or not
14:48 not um
14:50 um
14:51 but there
14:53 have to be some exceptions in the law to
14:55 handle some of the large
14:57 personal vehicles that are not commercial
15:02 i'm not going to worry about the details
15:04 of the vehicle registration act the
15:06 bottom line is you have to register your vehicles
15:07 vehicles
15:08 if they're going on the road the only
15:11 exception for registration is if they're
15:13 completely off-road
15:16 vehicles of husbandry or implements of
15:18 husbandry like tractors
15:21 now there could be engine registration
15:24 for air quality that's different
15:26 vehicle registration we're talking about
15:29 driving the vehicle over public roadways
15:31 and highways
15:34 registering engines for air pollution
15:36 standard controls
15:38 there is no exception that oh it's a
15:41 tractor it's off road only no you you
15:43 must comply
15:44 that's a different area we'll talk about later
15:46 later
15:50 but i'm not going to go through the
15:52 details here i'm not going to ask you on
15:55 a test about you know 110 million
15:57 dollars annually
16:00 those details change and i don't care
16:03 that you memorize some statistical numbers
16:04 numbers um
16:14 yeah you can essentially
16:17 just read through this on your own um
16:19 um
16:22 just understand what i said about
16:24 vehicles must be registered if they're
16:27 going to be used on roadways um
16:29 um
16:33 over 25 miles an hour and they're not
16:37 just used on the farm they're now public
16:38 public
16:41 highway and public roadway transportation
16:42 transportation
16:44 they need
16:50 and that's it that is it for vehicle rules
16:52 rules um
16:56 many of you may have not
16:58 known about how
17:00 that process worked and the fact that
17:03 tractors have different rules than
17:04 than
17:06 the rest of us
17:07 but it doesn't mean they don't have rules
17:08 rules
17:10 again just because agriculture has a lot
17:12 of exemptions it doesn't mean they're
17:15 exempt from laws they're just exempt
17:17 from the same laws they have different rules
17:18 rules because
17:19 because
